2. Prices
All prices refer to single items, ex works Sennwald, and do not include purchase tax, valueadded tax or packing and shipping charges. Interest shall not be given on advance payments. Prices are subject to alteration, especially as a result of fluctuations in currency value.

3. Payment
Accounts issued by BRUSA Elektronik AG are due for payment in advance (international orders) or, respectively, not later than 30 days after the invoice date (in Switzerland). The net amount of each invoice is payable and no deductions are permissible. Unjustified deductions shall be reinvoiced to the customer with the addition of an administrative surcharge to the amount of 1% of the net value of the order.
The goods remain the property of BRUSA Elektronik AG until payment has been received in full. The customer expressly agrees to this reservation of ownership.

4. Inspection on receipt
The customer shall inspect the goods immediately on receipt in order to verify the correctness of the delivery. Receipt of the wrong goods or wrong quantities must be reported in writing within eight days, otherwise the delivery shall be considered to have been accepted and found correct.

5. Warranty
The mechanical and electrical characteristics of the goods supplied by BRUSA Elektronik AG shall be in accordance with the data sheet on which the offer of sale is based (right of technical changes/modifications reserved). In case of deviations from this, BRUSA Elektronik AG shall determine whether the item or items are to be replaced at no cost to the customer, the deficiencies made good or the purchase price refunded.
BRUSA Elektronik AG shall not be liable under any circumstances for claims beyond this. In particular are removal and installation at the customers place as well as transportation from and to the customer not included in the warranty.
Faults or deficiencies must be reported within 60 days after receipt of the goods. A warranty period of 24 months max. 30 months from declaration of readiness for, during which faults or deficiencies will be made good, applies to all machines or appliances supplied by BRUSA Elektronik AG.
This warranty applies only when the machines or appliances have been installed competently and in accordance with the directions of the operating instructions. The warranty becomes null and void in the event of modifications made to the machine or appliance or in the event of damage caused by improper use. Other warranty obligations are expressly excluded.

6. Liability
BRUSA Elektronik AG shall not in any circumstances be liable for losses, damages or other liabilities, whether direct or consequential, resulting from the use of machines or appliances it has sold.

7. Changes
BRUSA Elektronik AG reserves the right to alter prices, at any time, as a result of changes in the market situation.
Technical changes/modifications in the interest of progress are possible at any time.

8. Delivery dates
A reasonable extension of the delivery period may occur as a result of an act of God, governmental order or interven-tion, business or transport disruption, industrial action, shortage of materials or similar occurrence preventing delivery within the agreed period. In the event of BRUSA Elektronik AG exceeding the agreed delivery period or extended period in accordance with the preceding provision, the customer has the right to stipulate a reasonable additional period of time of at least 2 months, and to withdraw from the agreement should its terms not be fulfilled before expiry of this additional period.

9. Applicable law and place of jurisdiction
Legal relations between BRUSA Elektronik AG and its customers shall in all respects be governed by Swiss law. The place of jurisdiction in case of dispute is Sennwald.
